About this Terms of service (“TOS”)

These terms of service (“TOS”) apply to the person or organization (“Customer” or “you”) agreeing to these Terms of Service and EnLightRipple LLC regarding your use of EnLightRipple LLC mobile apps, websites and related services (“Services”). As a precondition for using the Services, you must agree to these TOS. By using or otherwise accessing the Services, you agree to these TOS. If you do not agree to these TOS, you may not use or otherwise access the Services.
By accepting these Terms, signing an Order, or using the Services, you represent that you are of legal age and have the authority to bind the Customer to the Order, these terms of service (“TOS”).
EnLightRipple LLC may issue additional policies related to specific components of the Services. Your right to use the Services is subject to such relevant policies and these TOS.
Right to Use the Services
The Services accompanying this Agreement and all affiliated materials, including documentation and information (collectively the “Product”), is copyrighted. Scope of this agreement is the licensing (not selling) of the “Product” to You, as the “user” (either an individual or an entity). ENLIGHTRIPPLE LLC reserves all rights not expressly granted. ENLIGHTRIPPLE LLC does not grant any express or implied right to you under ENLIGHTRIPPLE LLC patents, copyrights, trademarks, or trade secret information.
Propietary Rights
You acknowledge that we retain all proprietary right, title and interest in the Services, our name, logo, characters, character names or other marks (together, the “EnLightRipple LLC Marks”) whether registered or not and all applications thereof. And any related intellectual property rights, including, without limitation, all modifications, enhancements, derivative works, and upgrades thereto. You agree that you will not use or register any trademark, service mark, business name, domain name or social media account name or handle which incorporates in whole or in part the EnLightRipple LLC Marks or is similar to any of these. EnLightRipple LLC reserves the right, in its sole discretion, to change, limit, or discontinue any aspect, content, or feature on the Services, as well as any aspect pertaining to the use of this Services.
Disclaimer of Liability and Warranties
The Services are provided “AS IS” without any express or implied warranty of any kind including warranties of merchantability or fitness for any particular purpose. It may have defects, and your use is solely at your risk. In no event shall EnLightRipple LLC or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of profits, business interruption, loss of information) arising out of the use of or inability to use the Services, even if EnLightRipple LLC has been advised of the possibility of such damages.
Your Content / Improper use
EnLightRipple LLC does not claim any ownership rights in your Content. You retain all rights to your Content and we do not own or license your Content. If you use our Services to generate a Content or you distribute it. You are responsible for this Content.
Your personal data may be revealed to responsible authorities if you use our services for illegal purposes. Our services may not be used for illegal or illegitimate purposes. You hereby declare that you are aware that we may be ordered to reveal your personal data to responsible authorities and that, in these cases, we may reveal your data without your prior consent.
Severability
If any provision of this Agreement shall be found by a court to be void, invalid or unenforceable, the same shall be reformed to comply with applicable law or stricken if not so conformable, so as not to affect the validity or enforceability of this Agreement.
Governing Law and Jurisdiction / Arbitration
This Agreement shall be governed by and construed in accordance with the laws of the State of California. You may only resolve disputes with us on an individual basis and you agree not to bring or participate in any class, consolidated, or representative action against us or any of our employees or affiliates. You agree not to bring an individual action against us or any of our employees or affiliates. If you do not agree to these TOS, you may not use or otherwise access the Services.
If necessary and in accordance with applicable law, we will cooperate with local, state, federal and international government authorities with respect to the Services. Notwithstanding any other provision in these Terms, we may immediately terminate the Agreement for noncompliance with applicable laws.
